Ed Sheeran won again when the second case against him that said he copied Marvin Gaye’s Let’s Get It On was thrown out. The lawsuit over copyright said that the song was too close to Sheeran’s Thinking Out Loud.

The second case was heard in a federal court in Manhattan. District Judge Louis Stanton was in charge of the case. Structured Asset Sales LLC brought the case, but the judge threw it out because the parts of Let’s Get It On that Sheeran is said to have copied are too common to be protected by copyright.

The singer had already won a case about the same two songs in this same court. The children of Gaye’s co-writers brought the case. Sheeran said this after the win:

“I’m just a guy with a guitar who loves writing music for people to enjoy. I am not and will not allow myself to be a piggy bank.”

He went on to say, “I’m obviously very happy with the outcome of the case, and it looks like I’m not having to retire from my day job after all. At the same time, I’m unbelievably frustrated that baseless claims like this are allowed to go to court at all. We’ve spent the last eight years talking about two songs with dramatically different lyrics, melodies, and four chords which are also different and used by songwriters every day worldwide.”
