Chemical Poisoning Risk With Unlabeled Food Containers: Inspections


ARLINGTON, VA — A number of facilities in Arlington recorded violations during recent inspections from the Arlington County Public Health Department. Inspectors conducted the most recent visits between March 26-April 1.

At one food establishment, an ACPHD inspector noticed that bulk food containers were not labeled. This could lead to food safety issues it it was not addressed.

“Consumers may be allergic to certain foods or ingredients,” the inspection report said. “The mistaken use of an ingredient when the consumer has requested that it not be used may result in severe medical consequences. Liquid foods and granular foods may resemble cleaning compounds. The mistaken use of food from an unlabeled container could result in chemical poisoning.”

  • Observed cutting boards heavily scored and scratched. Corrective Actions: Resurface or discard and replace the cutting boards to provide a food contact surface that is smooth, easily cleaned and sanitized.

  • Observed foods in the walk in (french onion soup – 44F, chicken mix – 45F) were holding above 41F. Corrective Actions: Adjust cooler, or relocate food to a refrigeration unit that is capable of maintaining food storage at 41°F or below. PIC adjusted cooler temperature during inspection.
  • The drains at the 3 compartment sink are unable to close and seal. Corrective Actions: Repair drains so that they are able to close
  • Observed pack of water bottles stored in dish area. Staff stated they were for employee use. Corrective Actions: Keep employee foods or beverages in designated areas, away from food prep or warewashing.

  • The floors especially under equipment and the ceiling vents were observed in need of cleaning. Corrective Actions: All floors, walls, and ceilings must be cleaned as often as necessary to keep them clean. Cleaning of the physical facilities is an important measure in ensuring the protection and sanitary preparation of food. A regular cleaning schedule should be established and followed to maintain the facility in a clean and sanitary manner.

Corrective Actions: Immediately discontinue the use of the machine until it is operating in accordance with minimum requirements. The range for proper operation is rinse temp at 180F, and equipment surface temperature reaching 160F. Initiate manual wash, rinse, and sanitize method to properly clean and sanitize equipment and utensils. To minimize workload you can move to all single service utensils.
  • Observed summer rolls holding on the countertop at 87F. Corrective Actions: Discard the food and ensure that potentially hazardous foods for cold holding are maintained at 41°F or below to inhibit the growth of harmful bacteria. Store TCS foods in coolers.
  • Wiping cloths improperly stored between use. Corrective Actions: Ensure wet wiping cloths are stored in a chemical sanitizer at the proper concentration between use.
  • Observed knives stored in between prep tables. Corrective Actions: Store in-use utensils or dispensing utensils in one of the following manners: 1) In the food with their handles above the top of the food and the container. 2) In food that is not potentially hazardous with their handles above the top of the food within containers or equipment that can be closed. 3) On a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food-contact surface of the food preparation table or cooking equipment are cleaned and sanitized every 4 hours. 4) In running water of sufficient velocity to flush particulates to the drain. 5) In a clean, protected location if the utensils are used only with a food that is not potentially hazardous. 6) In a container of water if the water is maintained at a temperature of at least 135°F and the container.
  • The mechanical warewashing machine was not operating in accordance with the manufacturer’s specifications, unable to dispense sanitizer. Corrective Actions: Discontinue the use of the low temperature chemical sanitizing ware wash machine until it is working properly. Initiate manual wash, rinse, and sanitize method to properly clean and sanitize equipment and utensils. To minimize workload you can move to all single service utensils.
  • Observed that walls near prep line and behind dish area are in need of cleaning. Corrective Actions: Clean floors and walls frequently to prevent the buildup of food debris.

What Violations Do ACPHD Inspectors Report?

In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected. Sometimes, the follow-up inspection only considers the most important “priority” violations.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection. Depending on the results of the inspection, the health department can pursue several actions.

They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.
The Virginia Department of Health only recommends restaurants have their permits suspended when “the continued operation of the food service presents a substantial and imminent threat to the public health.”
