A routine traffic stop resulted in the arrest Thursday morning of the driver on felony and misdemeanor charges after drugs were allegedly found in the vehicle.
Shane Allen Magby, 44, who lists a Smokey Place address, was taken into custody around 10 a.m. and charged with possession of a controlled substance, meth, punishable by up to 10 years in prison, and possession of drug paraphernalia, punishable by up to six years, and a misdemeanor count of driving on a suspended license.
Magby was later released on a $6,250 bond and is set to appear Dec. 19 in Garland County District Court.
According to court records, Magby pleaded guilty to possession of a controlled substance with purpose to deliver and possession of drug paraphernalia in 2015 and was sentenced to three years’ supervised probation; to possession of a controlled substance and drug paraphernalia in 2017 and was sentenced to four years in prison; and he was arrested on April 18, 2022, on two felony counts of theft by receiving involving AT&T phone wires and is set for a hearing on Jan. 22.
According to the probable cause affidavit, shortly before 10 a.m., Hot Springs police Officer Austin Morphew made a traffic stop on a black 2001 Ford Mustang for having unconfirmed insurance at Central and Woodlawn avenues.
Morphew reportedly recognized the driver as Magby, who he knew to have a suspended driver’s license, so he took him into custody. The female passenger did not have a valid license, so the vehicle had to be towed.
While doing an inventory of the vehicle prior to being towed, Morphew noticed the center console was not secured and was “wobbling while moving items inside of it.” He lifted the console and allegedly found a blue bag that contained 4.1 grams of what later tested positive for meth, another smaller bag with 0.9 grams of meth, for a total of 5 grams, and a glass bowl pipe with burnt residue.
The female passenger, after being read her rights, was questioned about the drugs and stated she had “no knowledge of the items” and that she doesn’t use meth so she was released from the scene and Magby was later charged in connection with the items found.
